THIS PRIVACY POLICY (“POLICY”) GOVERNS THE INFORMATION THAT CRASHDETECH (PTY) LTD t/a ROADSAVE (“ROADSAVE”, “WE” OR “US”) COLLECTS THROUGH THE ROADSAVE WEBSITE AND CHATBOT SOFTWARE (“WEBSITE”) AND THROUGH THE ROADSAVE SMARTPHONE SOFTWARE APPLICATION (“APPLICATION”), INCLUDING VIA YOUR COMMUNICATIONS AND INTERACTION WITH ROADSAVE. YOUR USE OF THE WEBSITE AND THE APPLICATION SERVICES IS SUBJECT TO THIS POLICY. BY USING THIS WEBSITE, YOU INDICATE THAT YOU CONSENT TO THE PROCESSING OF YOUR PERSONAL INFORMATION IN CONFORMITY WITH THIS POLICY. IF YOU DO NOT AGREE WITH ANY TERM IN THIS POLICY, PLEASE DO NOT USE THIS WEBSITE, APPLICATION –OR SUBMIT ANY PERSONAL INFORMATION THROUGH THIS WEBSITE OR APPLICATION.

ROADSAVE WILL MAKE AMENDMENTS AND/OR UPDATES TO THIS POLICY ON OCCASION. AMENDMENTS MADE TO THIS POLICY SHALL BECOME IMMEDIATELY EFFECTIVE AS AT THE DATE OF REVISION. WE ENCOURAGE YOU TO PERIODICALLY REVIEW THIS POLICY TO KEEP INFORMED ABOUT HOW WE ARE PROTECTING YOUR PERSONAL INFORMATION. YOU CAN FIND THE LAST DATE OF CHANGE MADE TO THIS POLICY FOR YOUR REFERENCE BELOW. YOUR CONTINUED USE OF THE WEBSITE AND APPLICATION SERVICE EVIDENCES YOUR ACCEPTANCE OF THIS POLICY AND ANY UPDATES MADE TO IT. FOR THE PURPOSE OF THIS POLICY, PERSONAL INFORMATION IS DEFINED IN ACCORDANCE WITH THE DEFINITION IN THE PROTECTION OF PERSONAL INFORMATION ACT 4 OF 2013.

1. INFORMATION COLLECTION AND USE

Information that data subjects provide to us:

1.1. RoadSave and/or its authorised technology agents collect and process certain Personal Information of its data subjects in connection with their use of the Website and/or the Applications, products and/services provided to them by RoadSave. RoadSave’s data subjects include: Website visitors and users, Application users, Members, Providers, people who send enquiries or requests to our call centre and/or partner call centres, people who send enquiries or requests to our suppliers and/or product/service providers and/or duly appointed marketing affiliates.

1.2. RoadSave and its authorised agents obtain Personal Information that you provide when you use the RoadSave Website and the RoadSave Applications, either through your communications with us or through the information that you provide when you register with and/or use the Application service, or the information that you provide to our authorised agents in order to receive vouchers, request subscription and send queries. RoadSave collects and processes this information in order to respond to your communications, pass on your communications to the correct person or department and effectively provide the Application service to you.

1.3. For the purpose of this Privacy Policy, Personal Information is defined in accordance with the definition in the POPI Act. In particular, however, RoadSave collects the following information:

1.3.1.    first name, surname, ID number and profile photo;

1.3.2.    email address;

1.3.3.    mobile phone number;

1.3.4.    country of residence;

1.3.5.    birth date;

1.3.6.    medical aid name and membership number;

1.3.7.    blood type;

1.3.8.    allergies;

1.3.9.    medical conditions;

1.3.10. height;

1.3.11. weight;

1.3.12. emergency contact person name and number;

1.3.13. vehicle information;

1.3.14. banking details and/or card details from the following persons: RoadSave Members where such members chooses debit order and/or card as payment option;

1.3.15. a list of the products and/or services you indicate an interest in or have made use of;

1.3.16. information specific to products and/or services we and/or our partners provide;

1.3.17. your interests, demographics, income, age, location, experience and feedback on our products and contact preferences in order to provide you with further correspondence about our products and services.

1.4. Your Personal Information is processed for the following purposes:

1.4.1.    to provide you with the requested products and/or Application services as per your subscription choice. Kindly refer to Our Terms and Conditions for more information on subscriptions;

1.4.2.    enable ease of use of the Website;

1.4.3.    process and facilitate transactions concluded by you or on your behalf;

1.4.4.    engage in electronic communications and transactions with you;

1.4.5.    enable us to communicate with credit bureaus and submit your ID number to the relevant credit bureau in order to obtain your credit score in the event that you wish to make use of our Marketplace service;

1.4.6.    provide you with customer support services;

1.4.7.    to track events on our Application/Chatbot/Website to retarget subscribers accordingly;

1.4.8.    to facilitate and enter you into any competitions which you enter in terms of Our Competition Terms and/or in order to process, confirm and facilitate your acceptance and/or use of a prize should you be announced as a winner;

1.4.9.    to administer competitions or promotions or surveys or similar interactive activities; 

1.4.10. to provide you with newsletters or other periodic communications and/or marketing materials or to market related services to you in a manner that complies with the Consumer Protection Act 68 of 2008 and the POPI Act and to facilitate the provision of the related services to you by our third-party partners.

Information that we collect automatically:

1.5. Personal Information is automatically collected in relation to your visit and use of the Website and Application service. Such information includes but is not limited to: your browser type and version, as well as your operating system, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application and/or the Website.

1.6. Cookies are small files sent from a Website to a User’s computer drive that can be used to track when a User visits and re-visits a Website and how they behave on a Website. RoadSave may use cookies to identify the device with which you access the Website and may use anonymous cookies to determine Website usage analytics and statistics in order to optimise the Website. By using Our Website and/or Application services, you warrant that you have read and agreed to Our Cookies Policy, available here.

1.7. The Website hosting agents and/or service providers may automatically log your “IP address” which is a unique identifier for your computer and/or other access device. Such information collected is for aggregate purposes only and cannot be used to identify you personally.

1.8. In the event that you subscribe to RoadSave and/or to receive further information through other periodic communications, from RoadSave, your Personal Information will be processed by RoadSave to provide you with such information and associated processes. All RoadSave communications shall contain an unsubscribe link which you can follow in order to be removed from the relevant list. You shall be removed from the relevant distribution list and RoadSave shall no longer send you the subscription information. Transaction specific communication will still be sent as part of your continued use of our services.

Geolocation Information:

1.9. RoadSave uses GPS technology (or other similar technology) to determine your current location in order to provide you with immediate emergency services should you be involved in a motor vehicle accident. We share your location with third-party partners in order to provide the Application service to you. Third parties that have access to your geo-location include Europ Assistance, whose services include: providing the emergency response call centre; dealing with the motor vehicle accident alerts and emergency requests; and have access to emergency response personnel. Emergency response personnel will have access to your geo-location in order to immediately find you in an emergency.

1.10. If you do not want us to use your location for the purposes set forth above, you will not be able to make use of the Application.

Medical lnformation (Special Personal Information):

1.11. Medical and health-related information is considered to be ‘special personal information’ in terms of the POPI Act. RoadSave treats your medical and health-related information in compliance with these provisions. In light of this, RoadSave requires your express consent to process your health-related information before you can subscribe to our Website and Application Software services. The subscription process includes linkage to this Policy and the Terms and Conditions of Service. By agreeing to continue with the subscription process, you are consenting to the processing of your health-related information as described in this Policy. We share your health-related information with third-party partners in order to provide the Application service to you. Third parties that have access to your health-related information include Europ Assistance, who provide the emergency response call centre, deal with the motor vehicle accident alerts and emergency requests, and have access to emergency response personnel. Emergency response personnel will have access to your health-related information in order to effectively treat you in an emergency.

1.12. If you do not want us to use your medical and health-related information for the purposes set out above, please cancel your subscription or do not subscribe.

Camera: 

1.13. We access the camera on your device (with your permission) to take your profile picture and to allow you to share quotes, vehicle and other pictures with us in order to provide you with our services.

2. CHATBOT: “JONO”

2.1. “Jono” refers to a chatbot service that enables you to interact with the owner and facilitator of this Service: RoadSave, via the chatbot/assistant bot. Services of this Chatbot must be used only in accordance with Our Terms and Conditions.

2.2. Our chatbot service asks for Personal Information about you and processes it against Personal Information that it may already have about you (as previously submitted by you) in order to provide responses to questions. By continuing to use the chatbot service, you signify your consent that we process your Personal Information through the chatbot service in accordance with the terms of this Policy.

2.3. By continuing to use Our chatbot service, you warrant that you understand that the output provided by the chatbot service constitutes automated-decision-making and your use of the chatbot service is done in connection with this Policy and the Terms and Conditions.

2.4.  You warrant that you understand that Jono is a chatbot and has certain limitations. Any recommendations or advice provided on the chatbot is for general informational purposes and we expressly exclude any liability for any action taken by you based on such recommendations or advice. We do not guarantee that using our Website, Application services, or Content will result in unique or your desired outcomes. Jono, as a chatbot is not a representative of professional and/or Certified Advisor and/or Legal Practitioner.

2.5. The Website and Application and Software are provided “as is” and is used at your own risk. We cannot provide any express or implied warranty or condition of any kind in relation thereto. We also disclaim any warranties of merchantability, fitness for a particular purpose or non-infringement. Although we have the necessary security safeguards in place, RoadSave will have no responsibility, by your use of the chatbot, for any harm suffered by Your computer system, loss or corruption of data, or other harm that results from your access to or use of the service.

 

3. THIRD-PARTY ACCESS & DIRECT MARKETING

We will share your information with third parties only in the manner as described in this Policy.

Which third parties have access to your information and why.

3.1. Europ Assistance, who provides the emergency response call centre, deal with the motor vehicle accident alerts and emergency roadside requests, and have access to emergency response personnel, will have access to your information in order to provide the emergency service. Emergency response personnel will have access to your medical and personal information in order to provide a more effective medical service at the scene of the emergency.

3.2. Telesure Investment Holdings and/or its subsidiaries and/or King Price Insurance will receive your personal information in order to provide quotes on insurance and/or related products. 

3.3 AIG Life South Africa Limited will receive your personal information in order to provide insurance cover and/or to provide quotes on insurance and/or related products.

3.4. PayGate & Netcash provides payment services. PayGate & Netcash will thus have access to the necessary personal and bank account information in order to set up the fee collection, when required, and for the purpose of collecting debts owed by you to RoadSave.

3.5. RoadSave uses Afrihost as an Internet Service Provider. Afrihost uses software programmes and hardware devices to monitor network traffic in order to identify unauthorised attempts to access, upload, damage or alter information that it has stored. Afrihost’s servers are located in South Africa. Your Personal Information is not transferred across the border of the Republic. Should it come to our attention that Afrihost’s servers are re-located outside of South Africa, or if we change our Internet Service Provider, we will amend this Policy in order to notify you of this change. However, RoadSave makes use of third-party service providers such as Unbounce (landing pages), Customer.IO (electronic communications), Zapier (integrations), Landbot (chat functionality), Zoho (CRM) and FreshDesk (CRM). In these cases, your Personal Information is transferred across the borders of the Republic of South Africa and your use of Our Website and Application services signify your consent to us transferring your Personal information to the aforementioned third-party service providers. It is Our understanding that these third parties process Personal information in line with the Privacy Laws within their jurisdictions.

3.6. Marketplace Providers will receive your personal information on Accepted Offers in order to facilitate and conclude deal related interactions.

3.7. One Loyalty, Warranty Solutions, Fines4U and Renew Online will receive your personal information in order to provide value-added services. 

3.8. Optimum Asset Finance and/or Victory 7 and/or Value Your Car will receive your personal information and/or credit related information in order to provide value-added and/or finance related services. 

3.9. The Talent Index and/or their suppliers will receive your personal information in order to provide value-added services.

3.10. Smollan will receive your personal information for call centre and/or sales activities.

3.11. SydSen will receive your personal information for customer support services.

3.12. Consumer Profile Bureau and Transunion will receive your personal information to allow Us to pre-populate your information for certain services and/or to access your credit score for the purposes of determining your eligibility to receive vehicle finance, should you choose to make use of this service.

3.13. Where your use of, registration upon and/or subscription to the Website and/or Application is initiated through Blue Label Data Solutions (Our duly appointed lead provision and marketing affiliate), we will share your Personal Information with Blue Label for their record keeping purposes, in order to ensure your information on Blue Label’s data base is up to date and accurate. We do not provide Blue Label with any Personal Information of Data Subjects that do not contact us though Blue Label. We also do not provide Blue Label with more Personal Information than they already have on Data Subjects and the purpose of providing them with this information is to enable Blue Label to keep their information up to date. Kindly refer to Blue Label’s privacy policy for more information on how they process Personal Information of Data Subjects on their database.

3.14. Members who subscribe to the service via third parties specifically consent to the additional processing of personal information by the third party. Such consent is governed by the third parties Privacy Policy. By providing personal information to the third party, the Member specifically permits the third party to input such information into the RoadSave system.

3.15. Members will be provided with opportunities to explore third party offers through us. By agreeing and continuing to make use of the third-party services, your Personal Information will be shared with those third parties whose services you choose to make use of.  

RoadSave’s liability for third party usage of your Personal Information

3.16.     RoadSave has implemented safeguards in order to protect your Personal Information when it is in the hands of these and other third parties through agreements between these third parties and itself. RoadSave, however, will not be held liable for any illegal activity or activity which may result in your claim for damages pertaining to the protection of your personal data while it is under the care of such third parties.

4. CONSENT TO PROCESS PERSONAL INFORMATION

4.1. By using the Application and Website, you are consenting to our processing of your Personal Information as set forth in this Policy now and as amended by us.

4.2. By continuing with the subscription for the Application service you are consenting to our processing of your health-related and/or finance and/or credit related information.

4.3. By continuing with the subscription for the Application service you consent to the receipt of direct marketing communications from RoadSave or its duly appointed marketing affiliates (including Blue Label Data Solutions). This includes competitions, promotions, products, special offers and other information, which we think you may find interesting.

4.4. Processing shall include the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation, use; dissemination by means of transmission, distribution or making available in any other form; or merging, linking, as well as blocking, degradation, erasure or destruction of information.

4.5. This consent is effective upon accessing the Website and upon subscription to the Application service, and will endure until you have ceased accessing the Website or terminated your subscription to the Application service.

4.6. You expressly consent to RoadSave retaining your Personal Information once your relationship with RoadSave has been terminated for: aggregate, statistical and reporting purposes.

4.7. In the event that you wish to revoke all consent pertaining to your Personal Information and you would like RoadSave to remove and/or delete records of your Personal Information entirely, please notify RoadSave via email to the information officer, as set out in the table in section 6 of this Policy.

4.8. By using the Website or subscribing to the Application service, you represent that you are of the age of 18 or that a ‘competent person’ (as defined in the POPI Act) has given consent to allow you, a minor child to utilise the Website or Application service as the case may be. You, or a ‘competent person’ in the case of a minor, consent/s to the processing of Personal Information that belongs to you or, in the case of a minor, to the minor for whom you are responsible, in the manner described in this Policy. You agree that giving such consent means that you have given RoadSave permission to collect and process the child’s personal information in the ways described in this Policy.

4.9. You agree to allow us and/or third parties as per section 2 to collect further information about you from external sources, including credit bureaus where such information is required to deliver our product/service to you.

 

5. HANDLING OF PERSONAL INFORMATION

Accuracy of your Personal Information

5.1. You have the right to correct your Personal Information as well as to revoke your consent to the processing of your Personal Information by RoadSave. You do, however, understand that RoadSave requires your Personal Information to render the RoadSave services and should you decide to revoke your consent, RoadSave will not be able to provide you with such services.

5.2. RoadSave seeks to ensure the quality, accuracy and confidentiality of Personal Information in its possession. Push notifications and email and SMS communications will be sent to you on occasion to remind you to keep your Personal Information up-to-date on the Website and Application service. You are able to access and make corrections to your Personal Information via the Website and Application through your log-in details. Push notifications may be disabled but doing so will reduce or retard certain aspects of the Application service. In light of the services that We provide, it is in your best interests to make sure that your Personal Information is accurate and up to date. You agree to notify us as soon as any aspect of your Personal Information has changed.

Security and protection of your Personal Information.

5.3. RoadSave will take all reasonable measures in order to ensure your Personal Information is appropriately safeguarded, these precautions include, but are not limited to: the use of a sufficiently secure server and providing suitably secure payment mechanisms. RoadSave makes use of a secure cloud server to store your Personal Information.

5.4. Should an unauthorised person/s gain access to your Personal Information, RoadSave will contact you within a reasonable time to inform you of the security breach.

5.5. You agree that RoadSave may share your Personal Information with authorised third parties such as employees and service providers to RoadSave. RoadSave does not permit these parties to use such information for any other purpose than to perform the services that RoadSave has instructed them to provide. RoadSave has partnered with third-party service providers such as  Unbounce (landing pages), Customer.IO (electronic communications), Zapier (integrations), Landbot (chat functionality), Zoho (CRM) and FreshDesk (CRM).  In these cases, your Personal Information is transferred across the borders of the Republic of South Africa and your use of our Website and Application services signify your consent to us transferring your Personal information to the aforementioned  third-party service providers. 5.6. RoadSave will not sell, exchange or transfer your Personal Information to any third party except as required in the provision of the RoadSave services and in accordance with the consents provided by you.

5.7. Should RoadSave require use of your Personal Information for a purpose other than as specified in this Policy (for example, to extend invitations to view, buy or use other products or services), RoadSave will contact you to obtain consent for such use beforehand.

5.8. RoadSave personnel and paramedic staff have access to your Personal Information. RoadSave staff is required to handle your Personal Information with confidentiality, care and in a secure manner that prevents possible breach as part of their employment contracts. To the best of RoadSave’s ability, paramedic staff will be obligated to treat your Personal Information with confidentiality, care and in a secure manner, which prevents possible breach.

Records Management

5.9. RoadSave is required by the POPI Act to destroy or de-identify records of your Personal Information once the purpose for which it has been collected has been completed. Upon unsubscribing from the Application service, your Personal Information records will be duly de-identified in a manner that does not allow re-identification.

5.10. RoadSave may continue to process records of personal information, which are still identifiable for statistical and research purposes.

Records Retention

5.11. Records relating to the provision of the RoadSave services to you and the personal information submitted by you may be required to be retained in terms of legislated records retention requirements, RoadSave’s operational purposes and/or for production as evidence by RoadSave in legal proceedings.

 

6. DISCLOSURE OF PERSONAL INFORMATION

Instances when RoadSave will disclose your Personal Information

6.1. RoadSave may disclose your Personal Information under the following circumstances:

6.1.1.    to comply with the law or with legal process;

6.1.2.    to protect and defend RoadSave’s rights, equipment, facilities and other property;

6.1.3.    to protect RoadSave against misuse or unauthorised use of the Website and/or products and/or services; and/or

6.1.4.    to protect other Website Users or third parties affected negatively by your actions in use of the products/services and/or the Website.

 

7. UNSUBSCRIBING, OBJECTIONS, COMPLAINTS AND QUERIES:

7.1. Monthly subscribers can unsubscribe via the Application or on our Website. Subscribers that have a non-monthly subscription can send a cancellation request to: support@roadsave.co.za.

7.2. Should you require a correction to be made to your Personal Information that RoadSave keeps on record, or a copy of the record itself, or should you feel that you would like to object to the collection, use or processing of your Personal Information by RoadSave, then kindly send an e-mail to our Information Officer, whose name and details are set out below. We will endeavour to make the correction, provide you with the record (we reserve our right to charge a small fee in this case), cease processing of your Personal Information and/or delete it, in accordance with your request.
